FAQsWhat nationalities are permitted to purchase a property?

Turkey has a reciprocal agreement for the purchase of land and properties with the following countries; Germany, Austria, Switzerland, Belgium, Holland, England, Ireland, Russia, Spain, Italy, Canada, Luxembourg, Norway, Australia, France, Greece, and some other African and South American states. 

Do I have to be a resident or have a resident’s visa to purchase? 

No, To buy a property you do not have to have a Residents visa. This is only required if you want to stay longer than three consecutive months, or wish to have a phone or buy a car. Then the three months tourist visa is not enough.

What is the general buying process in Turkey?

After paying the reservation fee, your lawyer should carry out the title checks. A contract will be drawn up between the seller and purchaser. This will give details of the completion date, payment schedule and terms and conditions. When this is signed by all parties, the deposit is paid. You then apply for a security clearance to allow you to own a property in Turkey - this will often be applied for on your behalf by the developer. You can sign a Power of Attorney to conclude the necessary paperwork, if your circumstances require it.

What documents are required ?

Your passport(s) which will be copied and translated into Turkish and passport sized photographs. The notary's office works in conjunction with the title deeds office and the Aegean Army. The translated documents will be checked by the army to ensure there is no record of criminal intent or activity against Turkey and that any property being purchased by a foreigner is not in the proximity to or intended to be used for any military purposes.

 

After I have received the necessary permission to purchase, what happens next?

Your lawyer should carry out pre-completion checks. Following this, you (or your Power of Attorney) will sign a deed of transfer in front of an officer at the Land Registry, who then records you as the official owner of the property. The property tax is paid at this stage.

Do I have any Taxes and fees to pay for the purchasing?
 

There are some taxes payable, however some are a “once only tax” i.e. 3 % of the declared value of the property, Education and earthquake tax approx. 50 € All formal documentation and copies approx. 75 € Translator fees approx.

Notary - who will take me there? Will they speak English? Will all documents be translated into English?

All customers will be accompanied to the Notary by English speaking staff and all procedures will be explained in full. All documents are in Turkish but a translation of the Power of Attorney is available from us. Any other translations can be arranged with a government approved translator for a small fee.

What is a Tapu? Will all the papers be in my name?

The Tapu is the Title Deeds for the property. The tapu will be registered in either joint or single names at the purchaser's request.


    How long does it all take?

    It takes approx. 6-8 weeks to receive the final Tapu (Title Deeds) first it goes to a regional Tapu office then to a Military Head office in Izmir to check that it isn’t in a Military Zone. This is just a formality. If everything is approved then it takes just one day to complete. You then go to the Tapu office with a translator to sign the appropriate documents.


    Earthquake Tax?

    It is a statuary government requirement that all new buildings have earthquake insurance cover. Megaron Property  Service will provide this cover for the first year from purchase date. Additional cover can be purchased.

    If I sell my property can I take the proceeds back to the U.K.?

    Yes.

     Can I will my property to my beneficiaries?

    You can make a Turkish Will and leave your property to your beneficiaries, however if you hadn’t made a will, the property goes to your next of kin.

    Can I import my belongings/furniture and car into Turkey?

    You can, but it is expensive for transportation and Duty, so it may be advisableto purchase your furniture here.
